Flash Express

01 Definitions

“Flash” and “Flash Express”

means Flash Express Co., Ltd., shipment service provider included employees, recipient agents, and sub-contractors.

“Consignor”

means person who passes the shipment through Flash Express Co., Ltd.

“Goods”

means item which packed into packaging for processing shipment through Flash Express Co., Ltd.

“Packaging”

means a box which used for packed item regarded as the consigner agree to ship.

“Consignment Notes”

means a document provided by Flash Express Co., Ltd. and hand to a receiver as an evident of received parcels from a consignors.

02 Unacceptable Shipments

2.1 Documents contain confidential date or personal information.
2.2 Documents contain financial related such as credit card, debit card, banknote, or cheque.
2.3 Invaluable or rare-to-find goods such as painting or ancient goods.
2.4 Jewelry, metal, and gemstone.(Gemstone, jewelry with high value or which cannot be assessed)
2.5 Weapon or related, pirated, pornography, and unlawful goods.
2.6 Drug ,Electric cigarette and Alcohol product.
2.7 Explosives and hazardous goods such as spray can, batteries.
2.8 Toxic or chemical goods, dry ice.
2.9 Live animal, human or animal organs, human or animal remains.
2.10 Goods that emit an odor.
2.11 Parcel that packed with foam box, and included ice, dry ice, or cold gel. As well as to-be-controlled temperature along the shipment.
2.12 Plants
2.13 Improper packed parcel.
2.14 Parcel with the summary of length, width, and height more than 280 centimeters; or each of length, width, height more than 100 centimeters; or heavier than 50 kilograms.
2.15 Parcel which require Flash Express to obtain any special permit for transportation.
2.16 Raw or perishable products such as fresh meat, fresh seafood, vegetables and cooked food etc.
2.17 Parcel containing any liquid such as beverage or goods that contained liquid

03 Irreclaimable shipments

Goods made of fragile material such as glass, mirrors, stone, ceramic, or porcelain.
Fragile goods such as TV, cupboard, monitor, or chandelier.
Music instruments such as guitars, drums, and electones.
Used goods.
Amulet or talisman
Dry foods
Invoice, receipt

04 Procedure for consignor request warranty and claim lost or damage parcel during shipment.

4.1 Destination delivery confirmation

After confirming the destination delivery, If the customer or the origin branch of the complaint says that the package is abnormal (such as damaged, lost in tons) within 7 days (including holidays) will be considered according to the process. But if the complaint is over the time limit Will not consider in all cases. In case of parcel was damage after dispatched, receiver must take photo of damage goods and packaging in 4 dimensions, and send those photos to Flash Express via e-mail claim@flashexpress.com or contact Call Center 021682111. After Flash Express investigated and concluded that the parcel and goods was damaged during shipment, Flash Express will inform to consignor and gather the document for claim. Consignor must hand in those documents within 7 days (include public holiday and weekend) after were informed by Flash Express. Flash Express will be able to claim lost or damage during shipment unless consignor hand in those documents under the condition provided.

4.2 Lost or damage during shipment

In case of parcel was lost or damaged a during shipment, Flash Express will inform status to the consignor whose the parcel and gather the document for claim. Consignor must hand in those documents within 7 days (include public holiday and weekend) after were informed by Flash Express. Flash Express will be able to claim lost or damage during shipment unless consignor hand in those documents under the condition provided.

5.1 A copy of identification cards issued by government.

5.2 A copy of bankbook account for transfer damage fee.

5.3 Receipt of damaged goods or chat conversation between buyer and seller.

5.4 Pictures of goods.

06 Liability of Flash Express

6.1 Flash Express’s liability is limited to direct loss and damage and a maximum of 2,000 Thai baht per Consignment Notes unless warranty were included. And, the warranty is not covered the freight

6.2 For the goods which applied additional warranty of claim and lost. If any damage or lost of goods were mattered by Flash Express, Flash Express will response the damage or lost depend on actual price of goods and maximum of coverage agreed with Flash Express. And, the response is not covered the freight

6.3 Flash Express will not under any circumstances be liable for:

6.3.1 Lost or damaged for any shipment containing items listed in Section 2 and Section 3

6.3.2 Any lost or damage for shipment considering as false or incomplete declaration

6.3.3 Lost or damaged arising from delayed delivery of any shipment

6.3.4 Lost or damaged of any shipment due to circumstances beyond Flash Express control included damage from electrical or magnetic field, loss of data from electric storage, damage of goods that Flash Express were known. Act or omit by employee or unemployed person of Flash Express, recipient agent, sub-contractors, or Government officials.

6.3.5 Any indirect or consequential loss or damage.

07 Parcel inspected by Government agency

7.1 All parcels must be complied with all laws and regulations, including the Customs rules.

7.2 We reserve the right to open and investigate a parcel without prior notice. If the parcel is considered as dangerous or illegal goods.

7.3 In case of Police officer, Government agency or Customs officer have an attention to open and inspect the parcel, we must strictly comply with the instructions of the inspector without prior notice to Consignor and Receiver.

7.4 According to Clause 7.3, In case of Police officer, Government agency or a Customs officer have an attention to open and inspect the parcel, we reserve the right according to following details:

7.4.1 Flash will not responsible for any damage or uncontrollable situation that might impact the parcel during inspection process.

7.4.2 For a parcel which is inspected, the parcels will not cover by Insurance Policy. In case that the parcel is legal, company will review on a case-by-case basis.

7.4.3 For a parcel which is inspected or seize by Police officer, Government agency or Customs officer, A customer must contact to Officer directly in order to provide the information to get the rights of parcel by themselves.

7.4.4 For The customer who want Flash to ship the parcel after the officer release the parcel, such customer has to re-booking and pay transportation charges again.

08 Legal Application and Dispute Resolution

In consideration of the interests of Flash, except for conflicts with applicable laws, all disputes relating to these Terms and Conditions will be subject to the non-exclusive jurisdiction of the country court of the original origin of the express mail, and shall apply to the law of the country of origin, the sender may irrevocably accept this jurisdiction.
